DUI Penalties

In California, DUI penalties are set forth by strict state statutes.  When a person is convicted of DUI, the judge will refer to these statutes when deciding upon a just sentence.  In all cases, the DUI penalties will be affected by the facts surrounding the person's arrest, the person's BAC test results, local policies, and the ability of the prosecutor.

Sometimes, DUI penalties are subject to enhancements.  Penalties may be enhanced if the offender has a prior DUI conviction, was speeding 20 mph over the legal limit, refused to submit to blood alcohol testing, or had a minor below the age 14 in the car with him/her.

Below is a list of non-enhanced legal penalties for 1st, 2nd, 3rd, and 4th DUI convictions:

First DUI Offense
Jail: 48 hours to 6 months
Fine:  $390.00 to $1,000.00, with possible penalty assessments
License Suspension:  up to 6 months
Treatment Program:  Mandatory attendance in an alcohol treatment program.  If the BAC result was less than 0.20%, 3 months attendance is required.  If the BAC result was greater than 0.20%, 6 months attendance is required.

Second DUI Offense (within 10 years)
Jail: 90 days to 1 year
Fine:  $390.00 to $1,000.00, with possible penalty assessments
