(Description of Legal Problem)

After a person is arrested for driving under the influence, he or she may feel as if the situation is hopeless.  A DUI arrest is never easy to face, especially when there are so many life-changing legal penalties involved.  However, people who are charged with DUI have many defenses available to them.  With proper legal guidance, people can build a defense that will help them succeed in court.  Additionally, there are numerous ways in which a person can contest his/her DUI charges.  By working with a reputable DUI attorney, people may be able to employ several strong defenses to produce a winning outcome for their case.

Below are some defenses that may be established for certain DUI cases:

Radio frequency interference led to inaccurate breath tests results.
Believe it or not, radio frequency (from police radios) can cause breath alcohol test results to be higher than they actually are.  Several other factors can lead to inaccurate breath test as well, including asthma inhalants, mouth wash, and food consumption.

You were not read your Miranda Rights.
When law enforcement places a person under arrest, they must read that person his or her Miranda Rights.  Each person has the right to remain silent and the right to an attorney.  If an officer fails to read you your Miranda Rights, anything you may have said may be inadmissible in court.

Your blood alcohol concentration was still rising
It is important to remember that the blood alcohol test is supposed to determine the blood alcohol concentration during the time the driver was operating his or her motor vehicle, not the person’s BAC after the fact. This means there can be a significant difference between a driver’s BAC at the time of driving and the driver’s BAC at the time the test is taken.

Your field sobriety test results were not accurate.
There are many reasons a person may be unable to complete the tests to the standards of arresting officers.  Some common reasons include weather conditions, slippery roads, lack of instruction, poor instruction, poor coordination, poor lighting, or other physical impairments.  For this reason, the results of most field sobriety tests are inaccurate and should always be challenged.
