(Description of Legal Problem)

In Marin County, it is illegal to drive under the influence of drugs or alcohol.  According to California law, a person can be arrested for DUI for two reasons:  he or she is driving while impaired by drugs or alcohol, OR he or she is driving with a blood alcohol concentration of 0.08% or higher.

Being “impaired” is legally defined as the inability to operate a motor vehicle with the caution, attention, and alertness that one would typically exercise if sober.  Police may suspect that a person is impaired by alcohol or drugs if he or she is engaging in uncharacteristic driving behaviors, such as swerving, speeding, making irregular stops, and disobeying traffic signals. 

The second part of DUI law addresses the person’s blood alcohol concentration(BAC).  If an officer suspects that a person is driving under the influence, he or she will ask the driver to take a breath alcohol test.  The breath alcohol test will report the person’s BAC.  A driver will be charged with driving under the influence if his or her BAC result is 0.08% or higher.
Driving under the influence is a serious offense in the state of California.  People who are charged with DUI must be prepared to face harsh legal consequences if convicted.  These consequences will be enhanced if the driver has prior DUI convictions.  A person convicted of a DUI offence may have to spend time in jail, pay large fines, and lose his or her driver’s license.  For these reasons, people should never take their DUI charges lightly.
