(Description of Legal Problem)

In California, convicted DUI offenders may have to attend drug and alcohol abuse programs as part of their criminal punishment.  These programs are commonly referred to as DUI schools.  If a person is ordered to attend DUI school by the court, his/her attendance is mandatory.  Even if the court does not require a convicted offender to attend DUI school, the Department of Motor Vehicles may. The DMV may require the offender to attend DUI school for a set length of time before his/her driving privileges will be reinstated.  If a person fails to complete DUI school, his/her driver’s license will remain suspended until treatment requirements are met. 

The length of DUI school attendance will vary by case and depend upon several factors.  For example, a first DUI offense would merit less time in DUI school than multiple subsequent offenses.  In Marin County, first time offenders are usually sentenced with approximately 3 months in DUI school.  Second and third time offenders may be sentenced with 18 to 30 months in a drug and alcohol program.

At DUI school, offenders learn about the negative consequences associated with drug and alcohol use.  Offenders are also taught about drug and alcohol addiction.  If an offender feels that he/she has become addicted to substance abuse, the offender will be provided with resources and counseling referrals.  During DUI school, attendees also learn how driving under the influence can endanger other lives, as well as their own.  For many people, DUI school is an educational opportunity to correct prior reckless behaviors.
