Boats & Motorcycles
Boating Under the Influence
According to California’s Harbors and Navigation Code, it is illegal to operate a boat with a blood alcohol content of 0.08% or greater. Additionally, it is illegal to operate a commercial craft with a BAC of 0.04% or higher. A person who is convicted of BUI is subject to legal consequences, such as imprisonment, monetary fines, DUI School, community service, and probation.
Motorcycling Under the Influence
California DUI laws apply to all motor vehicles including cars, trucks, and motorcycles. A motorcyclist driving under the influence is subject to the same criminal process and criminal consequences as a person driving a car.
If a person is arrested for driving a motorcycle under the influence, the arresting officer will take away that person’s license. Additionally, if the individual refuses to submit to a breath alcohol test, his or her license will be automatically suspended. After taking the person’s license, the officer will also issue him or her a temporary driver’s license, which permits the person to drive for 30 days. During that 30-day period, the person should contact the DMV to schedule a hearing to contest the terms of his or her license suspension.
Driving a motorcycle under the influence is a serious offense in the state of California. People who are charged with DUI must be prepared to face harsh legal consequences if convicted. These consequences will be enhanced if the driver has prior DUI convictions. When a person is convicted of DUI, he or she may have to spend time in jail, pay large fines, and possibly lose his or her driver’s license.
